A reasonable, objective person would judge the conduct or comments by considering how the average person in the same circumstances would likely perceive them. This standard focuses on context, tone, and the potential impact rather than the speaker’s intent. If the behaviour could reasonably be seen as disrespectful, offensive, or inappropriate, it would likely be considered unacceptable under workplace expectations.

Case Scenario
During a team meeting, Alex makes a joke about a coworker’s accent, intending it to be lighthearted. While Alex believes everyone knows it is a joke, the coworker appears uncomfortable and becomes quiet for the rest of the meeting. Other team members exchange awkward glances.

When applying the Reasonable Person Standard, most people in the same situation would see the comment as inappropriate and potentially offensive, regardless of Alex’s intent. The impact, making a colleague feel singled out and uncomfortable, would outweigh the intention behind the remark.
